STATUS OF CHILD BORN IN UK TO NON-BRITISH CITIZENS

Child born in the uk to non-british citizens (Nigerian parents)

In ordinary law parlance, you get the status of your parents! It is derivative, your status at birth is derived and dovetails to you, except in countries where birth right citizenship obtains.


Lady we know came to UK on a student visa and gave birth in the UK.


Both the child's parents are Nigerian passport holders.

Could you please advise whether:

1st is her child entitled to British passport?

Answers:

Presuming the child was born after 2006:

-If the parents are NOT British citizens, - and/or one of the parents did not have ILR,

the child is not eligible for a British passport

The child can travel to Nigeria on a Nigerian passport but unfortunately the child cannot travel back to the UK with it.
